Recently, Hong Kong customs officials seized a large number of counterfeit brand-name clothing, shoes, handbags, Sunglasses, Electronic cigarette, etc. in a container to be transferred, with an estimated market value of about HK $1 million. This container was shipped from Nansha Port and will be transferred to Italy.

On the same day, customs conducted a risk assessment and randomly inspected a 40 foot container arriving from Nansha, Guangdong to Italy. After inspection, the customs officers seized the batch of suspected counterfeit goods in the container, about 900 suspected counterfeit goods, about 1300 suspected Electronic cigarette containing nicotine, and about 6100 suspected Electronic cigarette accessories.

According to the Hong Kong Commodity Description Ordinance, anyone who imports or exports counterfeit goods is considered illegal and can be fined up to 500000 yuan and imprisoned for five years on conviction. According to the Import and Export Ordinance, any person who imports alternative smoking products, including Electronic cigarette, heated tobacco products, herbal cigarettes and any related appliances, parts and accessories, shall be guilty of an offence and shall be liable to a maximum fine of two million yuan and imprisonment for seven years upon conviction.

The case is still under investigation. The Hong Kong Customs and Excise Department will continue to strengthen cooperation with mainland and overseas law enforcement agencies to crack down on cross-border counterfeit goods and smuggling of alternative smoking products.

In addition, according to the website of the General Administration of Customs, since the beginning of this year, the customs has taken strong measures to carry out multiple special actions for intellectual property protection, such as "Longteng", "Blue Net", and "Clean Net", and resolutely crack down on illegal import and export infringement. In the first half of the year, a total of 23000 batches and 50.7 million pieces of suspected infringing goods were seized.

In May of this year, the Comprehensive Department of the General Administration of Customs organized a special survey on customs protection of intellectual property rights in the field of cross-border e-commerce, and sorted out work ideas and measures on implementing internal and external coordination of intellectual property rights, regional linkage protection, and promoting the construction of a full chain protection system in new business formats such as cross-border e-commerce, solidly promoting the innovation of customs intellectual property protection system and modernization of governance capabilities. According to preliminary statistics, in the first half of the year, customs nationwide seized 21000 batches and 4.164 million pieces of suspected import and export infringement goods through shipping channels, including 12420 batches and 20700 pieces through postal channels, 410 batches and 1.7351 million pieces through express channels, and 8305 batches and 2.408 million pieces through cross-border e-commerce channels

The customs has always maintained a high-pressure situation in cracking down on illegal activities that infringe intellectual property rights through import and export. By focusing on analyzing the characteristics of infringing goods and historical seized data, they have strengthened clue analysis and risk control, organized law enforcement forces to increase the investigation and punishment of infringing goods in shipping channels, and improved the effectiveness of shipping channel infringement crackdown.
